UPCOMING TAX CHANGES
What the new software tax means for public agencies
Starting January 1, 2027, California sales and use tax applies to prewritten software and SaaS platforms, including eProcurement tools. SB 122, signed into law June 29, 2026, does not include an exemption for public agencies. Depending on your location, a rate of 7.25% to 11.75% will apply to the contract price of any new software purchase and every renewal.
What this means for procurement teams:
A new cost added to every software contract. Purchases, renewals, and multi-year agreements should now be evaluated on a tax-inclusive basis.
Pricing structure matters. How a vendor itemizes software, implementation, training, and support can affect how much of a contract is taxable. Ask for pricing details in writing before signing.
Solicitations and contracts may need updating. RFPs, ITBs, and contract templates should address the new tax. Work with your agency counsel before the effective date.
Some rules are still in flux. CDTFA has not confirmed how the tax applies to contracts that straddle January 1 or to renewals. Emergency regulations are expected by the end of the year. Do not assume any contract is exempt until final guidance is published.
